Terms of Service
Welcome to TenderSignals. These Terms of Service ("Terms") govern your use of the website tendersignals.com, the customer dashboard at account.tendersignals.com, our messaging bots, and related services (together, the "Service"), operated by TenderSignals, a United States sole proprietorship ("we", "us", "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What the Service Is
TenderSignals provides search, matching, alerts, and analytics for Philippine government procurement opportunities, based on publicly available data from the Philippine Government Electronic Procurement System (PhilGEPS) and other public sources.
Important: TenderSignals is an independent service. We are not affiliated with, endorsed by, or connected to PhilGEPS, the Procurement Service, or any government agency of the Republic of the Philippines. Official tender information should always be verified on the official PhilGEPS portal before submitting a bid.
2. Accounts
You must provide a valid email address to create an account. You are responsible for maintaining access to your email, since sign-in links are delivered there. You must be at least 18 years old and use the Service for business purposes only.
3. Free Trial
New accounts receive a free trial (currently 3 days) with full access. No payment method is required to start the trial. When the trial ends, access to paid features is restricted unless you purchase a subscription.
4. Subscriptions and Billing
- Paid plans are billed in advance on a monthly or yearly basis. Current pricing is displayed on our website (currently ₱2,490/month or ₱23,900/year).
- Payments are processed by third-party payment providers (currently Stripe; local payment methods such as GCash and Maya may be offered). We do not store your card or wallet credentials.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You can cancel at any time from your account or by contacting us; cancellation takes effect at the end of the current billing period. See our Refund Policy for details.
- We may change prices with at least 14 days' notice; changes apply from your next billing period.
5. Taxes
Unless stated otherwise, prices do not include taxes, duties, or similar governmental assessments. Where we are required by applicable law to collect taxes (such as value-added tax), we will add them to your invoice or state that they are included. You are responsible for any taxes applicable to your own business.
6. Acceptable Use
You agree not to:
- resell, redistribute, or systematically scrape data from the Service without our written permission;
- share one account across multiple organizations;
- use the Service for unlawful purposes or to send spam;
- attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
We may suspend or terminate accounts that violate these Terms.
7. Data Accuracy
Tender data is collected from public sources and refreshed regularly, but we do not guarantee that it is complete, accurate, or up to date. Deadlines, budgets, contacts, and award information may change on the official source at any time. You are solely responsible for verifying information before acting on it (including submitting bids). The Service does not constitute legal, financial, or bidding advice.
8. Intellectual Property
The Service, including its software, design, and original content, is owned by us. Publicly available government procurement data remains public information. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during your subscription.
9. Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We are not liable for lost profits, lost contracts, missed tenders or deadlines, or any indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.
10. Termination
You may stop using the Service and cancel your subscription at any time. We may terminate or suspend access for violation of these Terms, with notice where reasonably possible.
11. General
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service.
- Assignment. You may not assign your rights under these Terms without our consent. We may assign these Terms in connection with a reorganization or sale of the business, with notice to you.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control (including outages of third-party data sources or payment providers).
- No waiver. Our failure to enforce a provision is not a waiver of the right to enforce it later.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and update the date above; material changes will be announced by email or in the Service. Continued use after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the applicable laws of the United States and the state of registration of the proprietor, without regard to conflict-of-law rules, unless mandatory consumer protection law in your country provides otherwise.
